592 House Purchase Taxes.

We are about to complete on a house purchase in Le Marche. The property has been re-registered from Agricultural to Urban. The renovation is not yet complete but it will be our sole residence.

We had expected to pay a registration tax of 3% but have been informed that we must pay 10% as the house is not yet habitable!! As you might expect, this comes as quite a blow.

Any comments greatly appreciated.

Will you became resident in Italy ?

In this way you can pay 3% otherwise you must pay 10%

You can pay 3%, declaring that your house at the end of the renovation will not be a luxury house.

Our house is in the Commune of Peglio, very close to the beautiful town of Urbania, in the region of Pesaro e' Urbino.

The completion date is next week!! (22.06.2005) at the offices of the Notory in Urbania. Our lawyers are John Howell and Co in London, but an associate of theirs - JMU - Law Studio in Florence have been instructed to act on our behalf on the day. We have been informed by JMU that this is the tax we will have to pay. We had always thought that we could claim 'prima casa' on this purchase. Our lawyer in London (an italian) is now saying that it is up to the Notary what tax we will pay, and 10% seems to have been specified.

Do you think that there is any way that we can negotiate this payment at this late stage.

First of all consider that I can give an advice just in general, bacause I don't know, in the specific, your case.

Anyway, and talking in general, if you're buyng an house under construction, as I said, you can have "prima casa", if you have all the other requirements (residence etc.).
Tha question has been definitively resolved by the italian tax authority.

the references are in Banca Dati del Notariato, but I'm afraid you cannot get them, because it's a intranet, with no open access, but the notary that's going to draft the contract surely know what I'm talking and can find them.
