When we bought the house it was completey overgrown so we agreed the plans etc at that time. When the area was cleared you could see there was a single storey extension for sure and maybe a double storey extension (although unlikley) because both ground floor and first floor window opening had been bricked up. The house had to be demolished and rebuilt but I have a photo that supports certainly the outer wall and roofline of the single storey but its such a ruin that it could be interpreted a different way.
We decided at the early stages of the project to put a simple portico there and thats built.
The original footprint was 2.5m x 5m we want to move that to the back of the house but only 2m x 4.5m.
My concern is that the commune have been so difficult over the last 3 years(e.g. we have had the windows in for 12 months and after our geometra talking to them and agreeing the colour white they are now asking us to change the colour, seems a neighbour complained which does not auger well for the future!) that it could take anothe 2 or 3 years to resolve and we hoped to move permanently this year.
I guess I am trying to weigh up the risk and consquences of building the extension and then trying to resolve the planning later.

In our part of Le Marche you cannot extend your house and have to stick to the original volume ~ this would include any previous proven attached outbuildings/extension. A roofed portico ( ie a permanent roof with tiles) counts towards the volume of the house so the comune may consider that you have already included the volume of the previous single storey extension. I would be vey wary of just adding another part as if you have already used up your volume you could be heading for trouble and an expensive removal of said additions. However, I would double check with the geometra re the rules for your particular comune, they may be different to ours. Clearly people are watching how the rebuilding progresses so I doubt you would get away with it! Good luck anyway!

Agree with what Anne says about extending. If you have the old plans showing the outbuildings then it may be possible to show the original footprint of the house to help.
If the commune has turned it down, then it would be a disaster monetary wise to go ahead. The fines would be very high. Get your geometre to check it all out. As Anne says as well, everything goes on the volume and regulations are quite strict here in Marche

I don't understand what you are asking - could you describe the situation a bit more? Are you wanting to build an extension which the comune don't like, or have you bought a house with an extension which you are being told is illegal?
