In this case she was actually naming someone. If you don't name someone as in the Ulrika Jonsonn case with John Leslie in which she didn't actually name him, even though everyone found out who it was, he couldn't sue her.

Also, as in the messages I think you refer to, it is going to court. You can't libel someone in court.

You are right though, you have to be careful not to actually state who it is you are talking about.

I think you will find that the thread I think you are refering to is now done and dusted.

I think the person I think you are refering to should be flushed away.. along with some of the rot I think that person spewed in that thread.

Valgee, the issue boiled over in the thread that dare not speak its name, because the instigator of that thread did, effectively name the company that she was slagging off. The reference is now removed, so only saddos like me who spend too much time here can testify to it. And Aliena :)...she copies and pastes every thread into her little book...we're gonna be rich one day ;)

this was an individual against an individual, is not the same as an individual
against a company! also if we are going to use examples, then it is imposible
to show how many cases don't get to court, or are settled out of court.

i cannot see any similarites between this case, and what was being descused
on here........

I am reasonably familiar with libel/slander defamation laws and the how this relates to companies or corporations, as opposed to individuals. However, when individuals of a company are named (as may have been the case here through a web of PM's/emails sent with the intent they in turn would be sent to others), the boundaries are crossed and one should consider potential consequencies.

As for libelling in a court, of course you can't, but at least wait until you get there and hence be protected!
