11731 permission for electricity wiring refused by neighbour....

hi guys e ciao tutti
we in process of applying for electricity to get connected to our house in italy,nothing is quick as you know...but our geometre says the wire would have to go overhead of our neighbours land,and they have refused this,so our agent says it may be costly and take couple of months to arrange,does anyone have any advice weather they can leagally do this please?

Where in Italy are you? Things change all the time here in Umbria but we had this problem initially in 1999. (We actually had to find a VERY expensive temporary solution but this won't answer your question). I am of the opinion that you will get your electricity supply but it will take possibly months and you will have to keep on at who ever is involved in sorting it for you. Don't think you alone can get ENEL to organise the supply to your property even though the company will benefit! Your request will simply be put under the pile of papers waiting to be processed. (ENEL here use outside contractors for this job). Do you have both a Geometra and an Agent??? Decide which one will persue the matter for you and be prepared to pay them well when they succeed.

In my experience ENEL will do exactly what they want - they can run lines where they like and apply a vincolo to the land. It all depends on whether you are footing the bill or ENEL. If its a small palo with just the line to your house, it may be that your neighbours can refuse - or at least force you to go round the border of their property. ultimately though, I suspect the choice is ENELs and not your neighbours.

I wouildn't be too happy either (who would be?) if my neighbour wanted to cross [U][I]my[/I][/U] garden/land with his overhead electricity supply. I think I would object too and try and force ENEL to route it around my property!

Have just read your article and hopefully can shed some light on the issue.
Firstly as electricity is an essential service it cannot be denied by your neighbour, that's the law here in Italy.
The issue is that your neighbour has a right to object to overhead cables and request them to be put underground. This is where your problem is. Enel dont like to put the cables underground as it takes more time for the ground works. As you can imagine they need to dig down more than 1 metres avoiding other possible existing pipe work.
As a result you will have to pay a percentage more as the costs.
When we had the same problem we have the pipes put underground alongside the public road, then when the cable reached our property we had the cable overground.
The whole process took about a couple of months.
Best thing you can do is find out who are the enel contractors for your area and speak to them direct it will get the job done in half the time leaving it with your geometra.

Assuming you do eventually obtain all the necessary permissions you can offer to dig the trench yourselves (not literally obviously but you could always pay a man with a digger to do it for you - most are aware of the depth requirements). Not for electricity but for the phone cable we took this route and it dramatically reduced the waiting time as it meant we were not waiting for TI to sort it out. The 'hard work' had been done and all they had to do was lay the cable after which man with digger came along and filled it in again. If you have a digger on site for other work it really would be the simplest option, if not your geometra should be able to sort out some quotes. Depending on how the land is used could also be a major consideration re timing as obviously your neighbour would not appreciate any planted crops being dug up so you may have to tie the work in with whenever the crop is harvested.

No no no...you must not just find SOMEONE to simply call ENEL....nor is it likely that ENEL will allow anyone with a digger to dig the trench for electricity cables....(at least not around here). It is a case of "jobs for the boys".

So estherina 34 you have a Geometra (you haven't explainedthe Agent you mentioned??). He is the one to sort it for you face to face with ENEL and you must keep on to him to persue the matter. You will then pay him (far too much) for this service!
