9142 Private Road - Electrical Connection Question

I'm near the end of a new build in Sardinia, the villa is accessed down a private lane, along which we have a 'right of way'.

The electricity board will bring the power to the end of the public road. Although I have a right of way on the private road the electrician seems reluctant to dig the channel to the entrance until he gets a response from the neighbours who own the road.

The neighbours have been somewhat obstructive from day one, not because of anything against us, its more of a fall out they had with the previous land owner, and the builder, and as a result I have been told to expect them to take advantage of the situation, whatever that means.

I would just like to know where we stand legally in terms of our rights to dig up the road etc. I would be grateful if anyone could let me know.

It is unlikely that you will be able do much by yourself. Your neighbours can be as difficult as they please and so can ENEL. Your Geometra or Architect will be better equipped to negotiate and if you have to pay them, it will be worth it. We have been there...done that and learnt the lesson.

Thanks for the response Noble. I have asked my wifes nephew, our representative over there, to get the Geometra to intervene as he was supposed to oversee the job from start to finish.......well he said he would back in 2004 when he drew up the plans and took our money......needless to say, we haven't seen him since.

Anyway, hopefully he will get involved, thanks again for your reply.

I think I would take the reasonable approach by personal contact and if you are not too good on the Italian take along an Italian friend to help explain that you have heard of their previous bad experience and reassure them of your good faith etc and clearing up after job done etc and what would they see as a reasonable payment for their inconvenience and then suggest 50% and so on, until everybody happy. Good luck and be punctilious about payment probably in cash and you may reap the benefits in the future.
