Your estate agent should be checking this for you, probably via the municipio's cadastral registry, and be able to produce proof of clear title/no registered liens. We did once have to have the vendor settle a lien before closing, the payment wasn't the problem but getting the title cleared took a while.

I would say this is a job for the notaio. Although an estate agent can check certain things, the law of privacy prevents an agent peering too closely into the affairs of a vendor without his consent. The notaio must do a check on outstanding debts on the property before the rogito and any debts or records of debts show up at that point. These checks are expensive, and the notaio usually leaves them until the last minute (within 2 or 3 days of the act) to save money and the possibility that anohter charge could be taken out on hte property.
