Hello All,We are interested in buying a holiday property on Lake Como, with the idea that we can rent it out when we are not using it ourselves.We have found one that seems to fit the bill on all our requirements.It has three bedrooms and two bathrooms – but the third bedroom and second bathroom are in the roof space and are very cramped for head roof. At the lowest part the height is 1.1m at the highest part it is 2.7m. The agency has been quite upfront regarding this aspect saying that the roof space rooms do not meet the minimum height regulations ( sono inagibile ), but that this is not a problem as it is perfectly good to live in and rent – and we tend to agree but find it very odd.I wanted to ask the forum’s advice if we may have future problems in renting out an apartment wherein one of the bedrooms is below the minimum height? Best regards, Panda

Hello Panda,
there wouldn't be any problem if you used it yourself but, since it's inagibile (= you cannot live there) in case you rented it, the insurance wouldn't cover any damage to the people inside.
Also, the moment you decide to re-sell, the attic would not count as usable surface, since that's something you cannot legally fix. If the Notary knew about it, he could even refuse to sign the contract, since they're now obliged to check that everything being sold is in accordance with the laws and has proper permission.
It's a very common situation but it's necessary to know all implications.
