607 Building near rivers / Judicial auctions

Hello, I'm Maria Lucia Baldwin. New person.

My husband and I are about to bid for a property at judicial auction. The property is situated about 5m from a largish stream (3m wide). We wish to develop the property into Agriturismo / mini apartments. We are not looking to increase the volume. Does anyone have any info or links to sites on Italian planning law where I can do some research before contacting the commune? Or does anyone have any experience of judicial auctions thaat they would like to share?

Check to see if the property is always 5m from the stream. My local fiume is normally dry or just a small stream. In winter it is over 100 metres wide.

I understand your concern about the river, but it really is just a stream, but I will make further enquiries once we appoint a Geometra. The house on the other side of the stream (same altitude and distance) is currently being renovated by an Italian family - although I have no idea whether it is legal or not) Assuming (for the time being!) it is, my concern is more concerned with the change / intensification of use. I am just trying to find the official position before approaching the commune and appointing professionals.

yese there is a minimum distance , there is usaually a fascia that cannot be built upon close to rivers or the sea side.
Call the Comune and asks for the Ufficio tecnico, they will know.

judicial auctions are a cheap and affective way of buying property here and a good alternative if you speak italian to the regular estate agent road....

the stream location is as much of a problem as the local terrain indicates.... and will be obvious if there are problems... one thing about valley or stream locations is the lower temperature in winter.... often up to 10 c difference

all that said if the property is fine and you like it then alls well...

my only worda of caution would be about the proposal for agriturismo grants.... in all but name i would say these are well worn paths and have been commented on before.... you have to have enough land attached to the property...someone was mentioning the other day about either an existing rule or a proposed rule that you have had to have owned the place for a certain amount of yeras...three.. before you could apply... and after all that htese grants are hard to access as incomers and very rarely available to them.... if you are buying the property with your own funds to do it up fine...but make your financial planning on your own assets not any promises of almost fictional grants

Thank you for your advise. I have arranged to visit the local commune before the auction to ask about the river and get an impression of their general view of our proposals.

We will not be relying on grants, just a lottery win!

Having read all of this - this thread- it looks like a disaster waiting to happen. - - do you need all of this - there are literally thousands of places in Italy to consider without these complications - if you proceed, looks like sleepless nights to me???

You may prove to be right, but I hope not.

I have one very simple explanation. The property is fabulous and has a guide price of about 40% of the market value. I'm half Italian and have hot red blood running through my veins. So, it's the perfect match.

(PS My Yorkshire half agrees with you but is a much smaller than my Italian half!!)
